Terms of Service — ROASGuard AI

1. Acceptance of Terms

By accessing or using ROASGuard AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). ROASGuard AI is a product of JohnDigital Solutions Ltd. If you do not agree to these Terms, do not use the Service.

2. Description of Service

ROASGuard AI is an advertising intelligence platform that helps businesses audit, monitor, and optimise their Meta and Google Ads spend. The Service includes AI-driven ROAS analysis, anomaly detection, budget leak identification, and reporting dashboards.

3. Account Registration

To use the Service, you must register for an account using a valid email address. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Ensuring your account information is accurate and up to date
Notifying us immediately of any unauthorised use at support@johndigital.ke

4. Subscription Plans and Billing

ROASGuard AI offers the following plans:

Trial — 14 days free, no credit card required
Starter — $49/month
Pro — $139/month
Agency — $399/month

Subscriptions are billed monthly. Payments are processed securely via Pesapal. All prices are in US Dollars (USD) unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

5. Refund Policy

We offer a 7-day money-back guarantee for first-time paid subscribers. If you are unsatisfied for any reason, contact us at support@johndigital.ke within 7 days of your first payment. Refunds are not available for subsequent billing periods or after the 7-day window.

6. Ad Account Data and Privacy

When you connect your Meta or Google Ads accounts, you grant ROASGuard AI read-only access to retrieve performance data for analysis. We do not modify, delete, or create campaigns on your behalf. Ad account data is used solely to provide the Service and is not sold to third parties.

7. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorised purpose
Attempt to reverse-engineer, copy, or resell the Service
Share account access with individuals outside your organisation
Use automated bots or scripts to access the Service
Violate Meta's or Google's terms of service when connecting your ad accounts

8. Intellectual Property

All content, design, algorithms, and code within the ROASGuard AI platform are the intellectual property of JohnDigital Solutions Ltd. Your ad data remains your property at all times.

9. Disclaimers and Limitation of Liability

The Service is provided "as is" without warranty of any kind. ROASGuard AI provides data-driven insights and recommendations; we do not guarantee specific advertising results or ROAS improvements. In no event shall JohnDigital Solutions Ltd be liable for indirect, incidental, or consequential damages arising from use of the Service.

10. Termination

You may cancel your subscription at any time from your account dashboard. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes shall be resolved in the courts of Nairobi, Kenya.
